 22. Private Settlement Ends Brave Warrior Dispute

The Brave Warrior dispute that threatened to erupt into a legal catastrophe for the breeding industry has been settled before reaching court.

The Supreme Court writ that was issued over the death of Brave Warrior in 1998 has been withdrawn following the mediation of a confidential settlement.

The writ sought $23 million damages over the death of Brave Warrior after standing for only one season at Queensland’s Eureka Stud.

The case, if it had reached the Supreme Court, carried huge legal ramifications for breeders as it alleged negligence by Eureka Stud proprietors Colin and Scott McAlpine had resulted in Brave Warrior’s death.

Melbourne barrister Reuben Benkel chaired the mediation process between the McAlpine family and the plaintiffs, Queensland Turf Club committeeman Neville Bell and Brisbane Turf Club committeeman Doug Cowell, who were shareholders in Brave Warrior.

Benkel announced that Bell and Cowelll had agreed that the stallion's death was an "unfortunate and unforeseeable accident".

"The parties recognise the valuable contribution made by each other to the thoroughbred industry and wish each other continued success in their future endeavours in the industry," Benkel said.
